01Agreement to These Terms

These Terms of Service form a binding agreement between you and Boekweg Construction, LLC. By reading the site, sending an inquiry through the contact form, calling the shed office or engaging us to carry out a survey or a raising day, you accept these Terms. If you accept on behalf of a company, a trust or a family partnership, you confirm that you are authorised to bind that organisation.

If you do not agree with these Terms, please do not use the site and do not instruct us to begin work. You are always free to contact us by telephone to discuss a project without accepting the website terms, but any survey or framing work will still be governed by the written agreement described below.

These Terms apply alongside any written quotation, work order or signed contract for a specific project. Where a signed project contract conflicts with these Terms, the signed contract prevails for that project. Where no project contract exists, these Terms and the written quotation together form the whole agreement.

02Definitions

In these Terms, the Company means Boekweg Construction, LLC. The Site means the website at www.boekwegbuild.buzz and every page and file served from it. The Shed means the timber framing workshop and yard at 180 E 700 S, Mount Pleasant - 84647-2041, United States (US). The Client means the person or organisation that uses the Site or engages the Company. Services means the timber framing activities described on the Site and in any quotation.

Drawing Set means the plans, bent elevations, joint details and cut list prepared by the Company for a project. Raising Day means the date on which a frame is raised, including any preparation and any continuation into a second morning. Cut Tag means the physical label attached to a cut piece so that it can be identified on the laydown pile.

Words in the singular include the plural and the reverse. A reference to a statute includes any replacement or amendment. Headings are for convenience only and do not affect interpretation.

03About the Company

Boekweg Construction, LLC is a United States limited liability company working from the Shed in Mount Pleasant, Utah. The Company designs and cuts timber frames, builds porch trusses, repairs old beams and runs its own raising crews. The Company also publishes this Site under the developer name Boekweg Build.

The Company can be reached by email at build@boekwegbuild.buzz and by telephone at +16078914351. The postal address for correspondence and for deliveries is 180 E 700 S, Mount Pleasant - 84647-2041, United States (US). These details are the official contact points for every notice under these Terms.

The Company is not a lawyer, an engineer of record or a public authority. Where a project requires a certified structural design, a permit or an inspection, the Client is responsible for engaging the appropriate professional, and the Company will cooperate with that professional as described in the section on client responsibilities.

04Scope of Services

The Company offers six core services, each of which is described in more detail on the services page. These are barn frame raising crews, porch truss cuts, beam repair scarf joints, timber sourcing runs, shop drawing sets and raising day scheduling. Together they cover a frame from the first survey to the last peg.

A project may involve one service or all six. A client who owns a barn in need of a new plate may only need a sourcing run and a raising crew. A client repairing an old porch may only need a scarf joint and a shop drawing. The Company will confirm the scope in writing before work begins so that both sides know what is and is not included.

The Company does not provide roofing, electrical work, plumbing, foundations, legal advice or insurance. Where a project requires those elements, the Client must engage separate providers. The Company may recommend a provider but does not accept responsibility for the work of an independent third party.

05Surveys and Quotations

A survey is the first stage of almost every project. A member of the shed crew visits the site, measures the footing and the plate, records levels and photographs the building. The survey fee, where one applies, is stated in advance and is credited against the project cost if the work proceeds within ninety days.

A quotation is prepared from the survey and from the Drawing Set. Unless the quotation states otherwise, it is valid for thirty days and assumes that the information gathered at the survey remains accurate. If the site changes in that period, for example because a wall has moved or a footing has been replaced, the Company may revise the quotation.

A quotation is not a contract until it is accepted in writing and any deposit required by the quotation has been paid. Verbal acceptance may be recorded by the Company for convenience, but the written acceptance is the record that governs the project.

06Drawing Sets and Cut Lists

The Drawing Set prepared by the Company is the central document of a project. It records the plan, the bents, the joint details and the cut list against which timber is cut. The Client reviews the Drawing Set and must confirm that it matches the intended building before timber is sourced.

Once the Drawing Set is signed, changes to the design are handled as variations. A variation may change dimensions, add or remove a bent, or move a door opening. Each variation is priced and confirmed in writing before it is cut, because a change made after timber has been cut is far more costly than a change made on paper.

The final Drawing Set, including any marked-up revisions from the Raising Day, is retained in the Shed archive. The Client receives a copy at handover. The archive copy is the reference used if a repair or an extension is requested in later years.

07Client Responsibilities

The Client is responsible for confirming that the building is legally permitted and that the site is suitable for the work. This includes checking boundary lines, easements, covenants and any planning restriction that applies. The Company will not survey a site where access is disputed and will not cut timber for a building that cannot lawfully be erected.

The Client must provide accurate information about the building, including any previous repairs, known movement and the location of underground services. If a service line is not marked and the Company is asked to excavate or fix a footing, the Client accepts responsibility for that line. The Client is also responsible for securing the site and any livestock during the work.

Where the Client engages an engineer, an architect or a building inspector, the Client must share the relevant reports with the Company before cutting begins. A design that is changed after the Drawing Set is signed will be treated as a variation and may affect the schedule.

The Client must make timely decisions. A frame cannot be cut against an undecided design, and a Raising Day cannot proceed if access has not been cleared. Delays caused by late decisions may move the project in the queue.

08Site Access and Safety

The Client must provide safe and free access to the site for the crew, the crane, delivery vehicles and the removal of waste. This includes a laydown lane long enough for the longest timber in the Drawing Set and a crane approach that does not cross overhead lines. Where access is restricted, the Client must tell the Company before the survey.

On a Raising Day the Company controls the yard within the work area and sets a tape line for visitors. The Client and the Client guests must remain outside the swing radius of the crane and behind the tape line unless accompanied by the lift boss. The Company may stop work if the site becomes unsafe, and any delay caused by an unsafe condition is treated as a client caused delay.

The Client must ensure that the site has a first aid kit, access to drinking water and a safe place for the crew to shelter in bad weather. Where the site is remote, the Client should provide an address that emergency services can locate. The crew follows the Company safety plan, which takes precedence over client instructions on the work area.

09Timber Sourcing and Natural Variation

Timber is a natural material. Colour, grain, growth ring spacing, small checks and the exact dimensions of a sawn face vary from piece to piece even when the pieces come from the same log. These variations are not defects. They are part of what makes a timber frame distinctive, and the Company does not warrant that every face will match a sample exactly.

The Company sources timber on the Client behalf during a sourcing run. Species and grade are matched to the Drawing Set, and moisture is checked before cutting. Where a specified species is unavailable, the Company will propose a substitute and explain any difference in performance before the order is placed. The Client may refuse the substitute without penalty at that stage.

Timber may move slightly after delivery as it adjusts to local conditions. The Company allows for normal movement in the joint design. The Client should keep the frame from direct water during construction and should not force a joint that has become tight because of a change in humidity.

10Raising Day Scheduling and Weather

A Raising Day is scheduled against the weather window, the crane booking and the crew calendar. The Company issues the date, the gate time and the lift order at least a week in advance. The Client must confirm that the site will be ready on that date, including the footing, the laydown area and access for the crane.

High wind, lightning, heavy rain or unsafe ground may make a raise impossible. The Company may postpone a raise for safety reasons at short notice, and such a postponement is not a breach of these Terms. The Company will give the Client as much notice as the conditions allow and will reschedule to the earliest available slot.

The Company will not raise a frame that it cannot lift safely. If the site cannot support the crane or if the frame does not match the Drawing Set, the crew may stop work and the Client will be charged for the day and for the return visit. The Company will explain the reason in writing so that the issue can be fixed.

11Beam Repairs and Existing Structures

Beam repair work begins with an inspection of the existing structure. The Company will report what it finds, including rot, insect damage, checking and previous repairs that were not disclosed. The Client acknowledges that the full extent of damage in an old beam may not be visible until it is opened, and that the repair scope may need to expand once the beam is exposed.

Where hidden damage is discovered, the Company will stop and consult the Client before proceeding. Additional work is priced as a variation. The Company will not conceal a repair or disguise a failing beam in order to keep a quotation unchanged.

The Company does not warrant the structural adequacy of an existing building that it did not design. A scarf joint is designed for the load that the beam appears to carry at the time of inspection. If a building later changes use, for example from storage to a dwelling, an engineer should review the frame before the change takes effect.

12Fees, Invoicing and Payment

Fees are set out in the written quotation. Unless the quotation states otherwise, the Company invoices a deposit at acceptance, a further amount when timber is sourced and the balance on completion of the Raising Day. Repairs are invoiced on completion unless a different arrangement is agreed.

Payment is due within fourteen days of the invoice date. Late payment may attract interest at the rate stated in the quotation or, where no rate is stated, at the maximum rate permitted by law. The Company may suspend work on an unpaid account and may withhold a final Drawing Set until the account is settled.

Where the Client disputes part of an invoice, the Client should pay the undisputed portion and explain the dispute in writing within seven days. The Company will investigate promptly and will correct any error it finds. Raising a dispute in good faith is never treated as a breach of these Terms.

Quotations are exclusive of applicable taxes, permit fees and third party charges such as crane hire, haulage and engineering certificates unless those items are expressly included. Those charges are passed through at cost with any markup disclosed in the quotation.

13Changes and Variations

Every change to the scope is recorded as a variation. A variation is described in writing, priced and confirmed by the Client before the change is implemented. The Company will not carry out an unpriced variation on the understanding that it will be sorted out later.

Where a variation is urgent, for example where a hidden defect must be stabilised before the crew can leave the site, the Company may carry out the minimum safe work and confirm the price as soon as possible afterwards. The Client will be told at the time that the work is urgent and why.

A variation may affect the schedule. The Company will give a revised date for the affected stage when the variation is confirmed. If a variation is confirmed after the timber has been cut, the cost of replacing the affected pieces is included in the variation price.

14Cancellation and Postponement

The Client may cancel a project before the Drawing Set is signed without charge beyond any survey fee already incurred. If the Drawing Set has been signed but timber has not been ordered, the Client pays for the drawing work completed. If timber has been ordered or cut, the Client pays for the timber and for the cutting work already done.

If a Raising Day is cancelled by the Client within ten working days of the scheduled date, the Client pays for the crane booking and for the crew stand by where those costs cannot be recovered. The Company will always try to reassign the crew and to cancel the crane in time, and will pass on any saving.

The Company may cancel or postpone a project where the Client fails to pay, where the site is unsafe, where a permit has been refused or where the Client has misrepresented the building. In such a case the Company will refund any amount paid for work not carried out, after deducting costs already committed.

A cancellation must be given in writing to build@boekwegbuild.buzz. A telephone call is helpful but is not by itself a valid cancellation.

15Intellectual Property

The content of this Site, including the text, layout, styles and scripts, belongs to Boekweg Construction, LLC or is used with permission. You may read, download and print pages for your own private use. You may not copy large parts of the Site into another website, republish the content for commercial purposes or present the content as your own.

Drawing Sets prepared by the Company remain the intellectual property of the Company. The Client receives a licence to use the Drawing Set to construct, maintain and repair the building for which it was prepared. The Client may share the Drawing Set with a contractor, an engineer or a buyer of the building, but may not sell it or reuse it for a different building.

Photographs taken by the Company during a survey or a Raising Day remain the property of the Company. The Company will not publish a photograph that identifies a client without permission, and a client may ask for an image to be removed as described in the Privacy Policy.

16Website Use and Acceptable Conduct

You agree to use this Site lawfully and respectfully. You must not attempt to gain unauthorised access to the Site or its hosting environment, introduce malicious code, overload the Site with automated requests or use the contact form to send spam, threats or unlawful material.

The contact form is provided so that genuine clients, suppliers and applicants can reach the Shed. Messages that advertise unrelated services, attempt to sell search rankings or contain abusive language will be deleted without reply.

You must not frame the Site within another website in a way that suggests the Company endorses that website. You must not use the Company name or the developer name in a way that misleads a reader about a relationship with Boekweg Construction, LLC.

The Company may suspend access to the Site for maintenance or security reasons without notice. The Site is provided as is, and the Company does not warrant that it will be available without interruption.

17Warranty and Workmanship

The Company warrants that its cutting and raising work will be carried out with reasonable skill and care and in accordance with the signed Drawing Set. If a defect in workmanship appears within twelve months of the Raising Day, the Company will inspect it and, where the defect is attributable to its work, will correct it at no charge.

The warranty does not cover damage caused by weather beyond normal exposure, by movement of a footing, by alteration by another contractor, by failure to maintain the building or by a design supplied by the Client. It does not cover the natural movement of timber beyond the allowance built into the joint design.

A warranty claim must be made in writing to build@boekwegbuild.buzz within a reasonable time of discovering the defect. The Company may ask for photographs and a site visit before deciding how to proceed. The Company will not refuse a claim simply because the Client has not yet paid an unrelated invoice.

This warranty is in addition to any right that the Client has under applicable consumer protection law, and nothing in these Terms excludes a right that cannot lawfully be excluded.

18Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of rent or loss of use of a building, arising from a project or from the use of this Site.

Where liability cannot be excluded, the total liability of the Company in connection with a project is limited to the amount paid by the Client for the specific service that gave rise to the claim. Where the claim concerns the Site, the Company does not accept liability for a loss that was not reasonably foreseeable.

Nothing in this section limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that the law does not permit to be limited. If a court finds part of this section unenforceable, the remainder continues to apply.

19Indemnity

The Client agrees to indemnify Boekweg Construction, LLC against a claim, loss or expense that arises from the Client breach of these Terms, from inaccurate information supplied by the Client, from a site condition that the Client failed to disclose or from the Client use of a Drawing Set for a purpose other than the building for which it was prepared.

The Company agrees to indemnify the Client against a claim that arises from the Company infringement of a third party intellectual property right in a Drawing Set that the Company created without client input.

An indemnity under this section is conditional on the party seeking indemnity giving prompt notice of the claim, allowing the other party to participate in the defence and not settling the claim without agreement. Each party will act reasonably to mitigate its loss.

20Confidentiality and Privacy

Each party will keep confidential the non public information of the other party that it learns during a project. This includes site details, drawings, client plans and commercial terms. Confidential information may be shared with a professional adviser, an insurer or a subcontractor where that is necessary to carry out the project, provided the recipient is bound to keep it confidential.

Personal information is handled as described in the Privacy Policy, which forms part of these Terms. The Privacy Policy explains what is collected, why it is collected and how a person can exercise their rights. Where these Terms and the Privacy Policy appear to conflict on a privacy matter, the Privacy Policy prevails.

Confidentiality does not apply to information that is already public, that is independently developed without use of the confidential information, or that must be disclosed by law or by a court order. Where disclosure is required by law, the disclosing party will give as much notice as the law allows.

21Governing Law and Disputes

These Terms are governed by the laws of the State of Utah and by the federal laws of the United States that apply in Utah. The parties submit to the exclusive jurisdiction of the courts of Utah for any dispute that cannot be resolved by discussion.

Before starting a legal claim, the parties agree to attempt to resolve the dispute in good faith. The first step is a written notice that describes the issue and the outcome sought. The other party has twenty one days to respond. If that does not resolve the matter, the parties may agree to a mediation before a neutral mediator.

If a dispute proceeds to court, the prevailing party may recover reasonable legal costs where the law allows. Nothing in this section prevents either party from seeking urgent relief from a court where delay would cause irreparable harm.

If any provision of these Terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.

22Changes to These Terms

The Company may update these Terms from time to time. The date at the top of the page shows when the current version took effect. The version that applies to a project is the version in force when the project contract is signed, unless the Client agrees to a later version.

Where a change affects the rights of visitors to the Site, the Company will post a notice on the home page. Where a change affects an active project in a material way, the Company will write to the Client directly and explain the change.

Older versions of these Terms are kept in the Shed archive. A client may ask for a copy of the version that governed their project and the Company will provide it at no charge.

23How to Contact Us
